Privacy policy

Explanation

This Privacy Policy is based on Article 13 of the General Data Protection Regulation and contains the rights and obligations of BASED Nutrition with regard to external persons whose personal data it processes, mainly in the context of the online sale and marketing of goods and services.

This “Privacy Policy” governs the processing of your personal data by the controller: VAN BUEL BV, Zonnestraat 31, 9100 Nieuwkerken-Waas (Belgium), registered with the Crossroads Bank for Enterprises under the number BE0757.494.576 (hereinafter: “BASED Nutrition”).

Please read this Privacy Policy carefully, as it contains essential information about how your personal data is processed and which cookies are used. By providing your personal data through our website or via the mentioned contact channels, you declare that you have taken note of this Privacy Policy and you also expressly agree to it, as well as to the processing itself.

Article 1 – General

BASED Nutrition complies with the “Law of 8 December 1992 on the protection of privacy in relation to the processing of personal data”, as amended by the Law of 11 December 1998, as well as the anti-spam provisions from Book XII of the Code of Economic Law regarding the “law of the electronic economy”.

BASED Nutrition also brings itself in line with the European Regulation 2016/679 of 27 April 2016 on the protection of personal data through this current Privacy Policy.

Article 2 – Personal Data

2.1. Personal data you communicate to us:

  • Category 1: without registration: your IP address and Browse behavior
  • Category 2: your profile name, password, email address, login data, and (possibly your profile picture)
  • Category 3: upon registration or subscription to our newsletter: your email address
  • Category 4: via cookies: functional and non-functional
  • Category 5: your address details and payment information following the placement of an order or subscription

2.2. BASED Nutrition can collect your personal data in various ways:

  • a. by using cookies
  • b. during your registration and use of the Website for placing an order or subscription
  • c. when you contact us directly via email, telephone, post, message, or chat function

Article 3 – Purposes of the processing

3.1. General purposes
BASED Nutrition uses your data solely for the following purposes (as previously specified, with the legal basis being legitimate interest, performance of an agreement, or explicit consent, respectively):

  • Improving the website and user experience
  • Managing user accounts
  • Direct marketing and promotions
  • Technically necessary and marketing cookies
  • Delivery and invoicing of ordered products or services

3.2. Direct marketing
If you give your consent, we may send you marketing materials. You can unsubscribe at any time via email to info@basednutrition.eu, via the unsubscribe link at the bottom of emails, or through your account settings.

3.3. Transfer to third parties
In the event of reorganization, transfer, or cessation of the business, your data may be transferred to third parties. We strive to inform you of this in a timely manner. Your data will never be sold, rented, or shared without consent, unless legally required.

3.4. Legal requirements
In exceptional cases, we may be required to disclose data to government bodies or judicial authorities.

Article 4 – Automated decision-making

BASED Nutrition does not make decisions based on automated processing that have significant consequences for data subjects.

Article 5 – Duration of the processing

We retain personal data for as long as necessary for the processing purposes and legal obligations, including:

  • 7-year retention period for customer accounts, invoice, and payment data
  • 5-year retention period for consent to newsletter or marketing messages
